Online Sales Terms and Conditions
General
These terms and conditions together with our Delivery Policy and our Returns Policy (together these Terms and Conditions) apply to all online sales via this website. By purchasing products via this website you agree to be bound by these Terms and Conditions.
Where you are a Look Floors account holder and have previously agreed to our general terms and conditions of sale (General Terms and Conditions), our General Terms and Conditions will also apply to purchases you make via this website. In the event of conflict between these Terms and Conditions and our General Terms and Conditions, we will determine which will prevail.
We may alter or replace these Terms and Conditions at any time. All orders placed subsequently by you will be upon the altered or replaced Terms and Conditions.
Prices and Charges
The price of each product is the price shown on this website at the time that you place your order. The price of a product on this website may not be the same or correspond to the prices in any of our stores for the same product and we are not obliged to match any prices.
Prices for products change from time to time and we do not provide any advance notice of these changes.
Delivery, freight and handling charges are in addition to the price stated and are set out in our Delivery Policy.
All prices and charges on this website are in New Zealand Dollars (NZD) and exclude GST. GST will be payable in addition to the prices and charges and will be added at checkout.
Orders
You may order products by selecting the products you wish to purchase and submitting an order through this website in accordance with these Terms and Conditions.
Any order placed through this website for a product is an offer by you to purchase the product for the price stated (including the delivery and other charges and taxes if applicable) at the time you place the order. No order is binding on us until accepted by us.
You must provide us with current, complete and accurate details when placing your order, failing that we may not be able to fill your order and deliver the products in the manner you have requested.
We only supply products to customers within New Zealand. Regrettably orders placed from other countries cannot be actioned at this time.
Acceptance of Orders
You will receive an automated message confirming receipt of your order at the time it is placed.
We will send you confirmation as to whether or not we accept your order within 1 business day of receipt of your order.
If we do not have a particular product in your order in stock we will give you the option of selecting a substitute product or ordering the product on back order. If you wish to order the product on back order (Back Ordered Products) we will accept your order, but our acceptance of your order will be conditional upon being able to obtain supply of the Back Ordered Products within 30 days. We will notify you whether or not the Back Ordered Products become available within this period and, if so, the anticipated delivery date.
We may need to reject your order or part of your order where we have no stock of a particular product and the product is not available on back order or if there is an error in the price or the product description posted on this website or if you have breached these Terms and Conditions or our General Terms and Conditions. If we reject an order we will endeavour to notify you at the time, or as soon as practicable after, you place your order.
Each order that we accept results in a separate binding contract between you and us for the supply of those products in accordance with these Terms and Conditions.
Payment
We will accept payment using any of the following payment methods:
- Credit card (Visa, Visa Debit or Mastercard only);
- Direct deposit in the manner provided in our checkout process; or
- On Account, should you be an account holder with Flooring Wholesale Limited T/A Look Floors.
If you choose to pay by credit card, you authorize us to charge the amount that is payable to your nominated credit card.
If we are unable to successfully process your credit card payment for your order we may cancel your order.
If you wish to pay by direct deposit you must allow at least 48 hours for confirmation of your payment. If you do not deposit the relevant amount for your order into our nominated account within 3 business days of the date of order, then we will contact you. If you notify us at that time that you have not deposited the relevant amount for your order, then we may cancel your order unless other arrangements can be agreed.
We will provide you with a receipt at time of payment in full of the price of the products ordered and any applicable charges.
Delivery
Our Delivery Policy applies to all products ordered via this website.
Risk and Title
Where you purchase products on account, the passing of risk to and title in the products will be governed by our General Terms and Conditions. In all other cases, risk and title to the products passes to you at the time of delivery.
Returns
Our Returns Policy applies to all products ordered via this website.
Warranties and Liabilities
Apart from manufacturers’ warranties and any express warranties provided by us in relation to particular products, we make no representations and give no assurances, warranties or guarantees to you in relation to the products. To the maximum extent permitted by law, any warranty or guarantee implied by law, custom or practice is excluded. You specifically acknowledge that where you are acquiring the products for business purposes, the provisions of the Consumer Guarantees Act 1993 are excluded. You also acknowledge that where you are in trade the provisions of sections 9, 12A and 13 of the Fair Trading Act 1986 shall not apply for the purposes of section 5D of the Act.
To the maximum extent permitted by law we are not liable to you or any other person for indirect or consequential loss or damage of any kind however arising and our liability to you for loss or damage of any kind however arising is reduced to the extent (if any) that you cause or contribute to the loss or damage. Nothing in these Terms and Conditions is intended to limit or exclude any liability that cannot be excluded by law. Limitation, Suspension and Termination We may, at any time without notice, limit, suspend or terminate your access to and use of this website and (where relevant) your account and refuse to accept orders if you breach these Terms and ConditionsPrivacy
Our Privacy Policy applies to all information provided by you in ordering products from us.
Governing Law
These Terms and Conditions and each contract formed between you and us for the supply of products is governed by the laws of New Zealand and each party submits to the non-exclusive jurisdiction of the courts of New Zealand.
FORCE MAJEURE CLAUSE
No party shall be held responsible either financially or other for any inability or delay in fulfilling any part of a contract, agreement or any given quotation or accepted purchase order caused by events beyond their reasonable control, which will be referred to as "Force Majeure". Such events include, but are not limited to, natural disasters, accidents, civil unrest, wars, acts of terrorism, epidemics, pandemics (including the Covid-19 pandemic), quarantines, disruptions in communication infrastructures, failures of web hosts or internet service providers, governmental actions or inactions, amendments to laws or regulations, nationwide strikes, fires, explosions, or a widespread scarcity of raw materials or energy.
